Military Leave

Concept

Under federal statute, the member must be given membership credit for qualified military service as provided by the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). The member is not required to make contributions for this period of service. Additionally, Iowa Code 29A.28 generally requires the employing city to continue the employee’s salary for the first 30 days of absence due to military service.

Description

Due to current international affairs, the System is aware several of its members have been called to Active Duty. Because authorized leave has implications for the finances of the System, each city is requested to notify the System each time an individual is called to Active Duty. The city reports this information by returning an Authorized Leave Information form to the System. This information remains confidential in the member’s file, and is used for calculating service credit and verifying lapses in earnable compensation. Upon returning to the position, the individual is eligible for establishment of the service credit for the period they were absent. Upon notification from the System, the employing city is required to provide employer contributions for the period of military service.
